Bus driver Michael O'Rourke was shopping in the garden centre at Tallaght in Dublin on a Sunday afternoon in March 2009, when he was struck by a bale of fencing, which fell from the rack above him.

The DIY chain is to be sentenced later this month after pleading guilty at Dublin Circuit Criminal Court to a breach of health and safety legislation.
