Dublin family challenge eviction in court

A Dublin family have brought a High Court challenge to their eviction from local authority housing.

Christopher and Ann Moore are taking an action against Dun Laoghaire Rathdown County Council after the sheriff removed them from their home in Gleanntan, Loughlinstown for non-payment of rent.

Christopher and Ann Moore say their early-morning eviction last May has disrupted their family life with the couple and their three children now living separately with different relatives.

They had been in their Loughlinstown home since 1993 but had got into arrears owing more than €12,000 rent by 2008.

They want the High Court to declare their eviction was unlawful and say it was based on a defective warrant, a claim denied by the local authority.

They claim Article 8 of the European Convention on Human protects them from illegal interference in their home, even after the termination of a tenancy.

The court will give a ruling at a later date.
