Tesco to sue Dunnes for alleged misleading adverts

Supermarket chain Tesco have been granted permission by the High Court to take legal proceedings against Dunnes Stores over what it is claimed are misleading advertisements about the price certain goods are being sold at.

Today at the High Court, Ms Justice Mary Laffoy granted Tesco Ireland permission to serve short service of injunctive proceedings it intends to take against Dunnes Stores regarding three adverts that have appeared in the national media.

Mr Ciaran Lewis Bl for Tesco told the court that his clients are bringing proceedings because Dunnes are not correctly comparing prices that certain items are being sold at. Counsel said that what Dunnes were doing is in breach of consumer protection legislation.

Counsel said that correspondence sent by Tesco to Dunnes asking them to desist from running the adverts in question had been ignored. Counsel added that it was anticipated by his clients that these adverts maybe run again during the weekend.

Mr Lewis also told the court that while they are not notice parties the Consumer Protection Agency would be notified about the proceedings.

The Judge made the matter returnable before next Monday's sitting of the High Court.
