The state is appealing a high court award to the autistic man's mother and a judgement securing the right to an ongoing education for people with special matters of considerable constitutional importance.

But Mr Ahern said whatever the decision of the court, a payment of £215,000 already handed over to the Sinnotts will not be recovered.
