Boy gets €3,500 for swimming pool slip
The accident happened as the boy was stepping from the top of the stairs, across a short passage where water is pumped on to the surface before the actual slide itself.
Cian Mulcahy was aged 10 at the time of the accident on April 16, 2011, at Leisureworld, Churchfield. He brought the case to Cork Circuit Court through his mother, Merlyn Mulcahy of Mount Farran, Assumption Road, Cork, against the defendant company, Sport Ionad Reiguinach Chorcaí Teoranta.
The plaintiff’s barrister, Michael McGrath, opened the case before Judge Donagh McDonagh yesterday. He
said the hand bar was 0.99 metres away when a person steps into the area with water flow at the top of the stairs. Mr McGrath said the surface was smooth and slippery.
Judge McDonagh said that he would give the barristers an opportunity to discuss the case outside the court before calling evidence.
Later the judge was told that the case had settled for a sum of €3,500 offered by the defence to the plaintiff who is now 14.
The money was to be lodged for his benefit until he reaches the age of 18.
