Gardaí bailed on assault charges

Two gardaí facing assault charges were further remanded on bail at Limerick District Court yesterday.

Gardaí bailed on assault charges

Garda David Naughton, with an address in Lucan, Dublin, and Garda Wesley Kenny, with an address at Sandyford, Dublin, are charged with assaulting brothers, Luke and James Morrissey, at Catherine Street, on Dec 5, 2013.

Darach McCarthy, solicitor for the defence, told Judge Eugene O’Kelly that he was acting on behalf of another firm of solicitors and sought the case to be adjourned.

Mr McCarthy said the contested case would take in excess of a day as extensive CCTV footage would be involved in the evidence.

Sgt Donal Cronin agreed that the case would take some time as there was CCTV and other material to be got through.

Judge O’Kelly adjourned the case to September 24 for mention when a date for the hearing would be set.

On the application of Mr McCarthy, both accused gardaí were excused from attending court on that date.

The two officers — who are both based at Dublin city garda stations — were in Limerick City last December socialising when the alleged offences are said to have occurred.

Both assault charges are contrary to section 2 of the non-fatal offences against the person act 1997.
