Accused to be served with book of evidence in 5 weeks
Dean Fitzpatrick, aged 23, was found at an apartment at Burnell Square, Northern Cross, on the Malahide Road, Dublin 5 and was rushed to Beaumont Hospital where he was pronounced dead.
Mr Fitzpatrick, originally from Donaghmede in Dublin, was the brother of missing teenager Amy Fitzpatrick, who vanished in Spain six years ago.
Dave Mahon, aged 43, has been living in Spain with his partner Audrey Fitzpatrick, Dean and Amy’s mother.
Last Wednesday, after returning from Spain, he was remanded in custody after he was formally charged with his stepson’s murder.
Detective Garda Brendan Meares had then told Dublin District Court that Mr Mahon was “handed a true copy of the charge and made no reply after caution”.
On Monday, he was granted bail in his own bond of €10,000, of which €1,000 had to be lodged, and his father Michael Mahon was allowed act as an independent surety in the sum of €5,000.
The defendant, whose address had been listed on his charge as, The Crescent, Ongar Village, Clonsilla, Dublin 15, appeared at Cloverhill District Court yesterday.
State solicitor Nessa Moran told Judge Victor Blake, “my application is for a five-week remand for the service of the book of evidence”.
Ciara Durnin, defending, told the judge that there was consent to the prosecution’s request.
The judge granted the five-week adjournment and said the case would be listed on the next date for mention and possibly for the book of evidence to be served.
Mr Mahon, who was accompanied to his hearing by his partner and his father, did not address the court and was remanded on continuing bail.
He must reside at Lorcan Drive, in Santry in Dublin, sign on daily between 9am and 9pm at his local garda station, “notify gardaí of any change of address”, and Mr Mahon has had to surrender his passport, as a condition of bail.
