Aisling McCarthy-Brady, 34, from Lavey in Cavan, is at the centre of an investigation into the death of Rehma Sabir, who had been in her care, in Boston in January.

She is charged with assault and battery, causing substantial bodily injury to the child on or about Jan 14, the date of the baby’s first birthday.

The baby was hospitalised with severe head injuries and died two days later from her injuries.

Tomorrow, Ms McCarthy is expected to appear in Cambridge District Court in Massachussets, a month after her last hearing, at which her lawyer was granted the motion to preserve evidence, including Ms McCarthy’s daily journals about Rehma, the child’s travel itinerary, the hard drive from the Sabir family laptop, and all documents, emails, and internet searches since Jan 18 last year.

Also preserved as evidence is Ms McCarthy’s mobile phone.

Last month, Melinda Thompson, Ms McCarthy’s lawyer, said her client was “devastated because she didn’t do this”.

She maintains that the child’s injuries could have taken place at some time prior to Jan 14.

Ms McCarthy, who is being held on $500,000 ($375,000) bail, could be charged with murder following the release of the results of the autopsy.

According to the US Immigration Service, she will be deported regardless of the outcome of the case, as she has been living illegally in the US since 2002.
