A juror who was three days into a trial — including six hours of deliberating — claimed yesterday he could not take any more and wanted out.

The unusual development occurred at about noon yesterday in Cork Circuit Criminal Court where Evelyn Massey, aged 31, of Ballynoe Mews, Cobh, Co Cork, denied charges of dangerous driving causing serious bodily harm to Michael Sheehan at O’Donovan Place, Cobh, on May 18, 2008, and failing to remain at the scene.

There was some legal discussion on the law relating to the discharging of a juror. The legislation provides for a juror being discharged when he/she lacked ability or impartiality to continue.
