A CCTV system, close to a house where a shooting allegedly occurred, had not been functioning for almost three months before the incident, Limerick Circuit Court heard yesterday.

Gardaí had no part in managing the system which had been installed in O’Malley Park and monitored by the Limerick Regeneration Agency.

However, from time to time, gardaí obtained CCTV material from the system, the court heard.

The disclosure was made during a continuing trial in which Anthony Kelly, from O’Malley Park, is pleading not guilty to possessing a Glock pistol with intent to endanger life at his Southill home on October 28, 2009.

Sgt John Delaney, a Garda expert on CCTV systems, said a camera in the CCTV system was located near the home of the accused.

But it had emerged, he said, the camera had not been functional since 1.02pm on July 31, 2009.

Brendan Nix SC, for the accused, said he wanted to find out more about the lost images from the camera as they “would show the innocence” of his client.

The trial has been told how the accused man’s daughter was in a relationship with a neighbour, Michael Lynch.

The prosecution alleges Kelly shot and wounded Mr Lynch after a row broke out between the families on the night of October 27-28, 2009.

Mr Lynch, in evidence, recalled how he survived after a bullet entered his back, hitting his liver, kidney, lung and a rib before exiting through his chest.

The trial continues.
