A BRIDE’S action for damages over her wedding dress has been dismissed after the judge said he could find no evidence she lost the required inch in size to fit into the dress.

Last night, former model Paula Casey was left counting the cost of taking the action for damages against Mary Murray c/o Scarlett Bridalwear, Parnell Street, Ennis, after Judge Frank O’Donnell dismissed her claim and awarded costs against her for the case.

Judge O’Donnell had earlier remarked that “this might cost more than the wedding”.

Ms Casey of 2 Oakleigh Wood, Ennis, was seeking damages and repayment of the €1,594 she paid for the designer dress for her wedding on October 12, 2007.

Describing the night before the wedding, Ms Casey said a drinks reception at her home “resembled a morgue” because she couldn’t fit into the dress.

“Everyone was afraid to talk. There was a horrendous atmosphere. We were refusing people entry at the door because of the stress.”

Ms Casey described the frantic efforts to fit into the dress on the night, stating she was up until 4am trying to fit into the Justin Alexander dress.

Ms Casey’s seamstress, Geraldine (Gerry) Murphy was called to the Casey home the previous evening to make the dress fit.

Ms Murphy said she made alterations and came back to the house at 8pm, 10pm, 12am, 2am and 4am with revisions to the dress.

She said: “I fitted her as best I could.”

Ms Casey said with all the alterations to the dress, it had lost its shape and she had to hold it up for the wedding. Ms Casey said walking up the aisle, the stitches holding the dress together were visible.

Ms Casey admitted when trying on the sample US size 12 dress at Scarlett Bridalwear on May 22, 2007, staff wrote on the sales order she had to lose an inch on her waist and her bust to fit into the dress. Ms Casey said she did lose the weight and had a personal trainer.

Counsel for Ms Murray, Pat Whyms BL, said the wedding dress Ms Casey bought was the same size she tried on in May and she didn’t lose the inch as she was advised.
