The former All-Ireland winning Cork hurler and footballer was sentenced to two months in jail last September after he was convicted at Cobh District Court of failing to give a blood or urine sample to gardaí when stopped on suspicion of drink-driving in November 2006.

McCarthy, 42, of Woodbrook, Castlejane, Glanmire, County Cork, was also convicted of dangerous driving and failing to produce insurance when stopped by gardaí at Riverstown Cross, Glanmire, on November 21, 2006. But at a sitting of Cork Circuit Appeals Court in Midleton yesterday, McCarthy appealed the severity of the prison sentence and escaped with a €750 fine.
