Man charged with murder of brother in house row
Derek McGrath, aged 35, of Fortlawn Park, Mountview, Blanchardstown, Dublin 15, is accused of murdering Tony McGrath at his home at Whitestown Walk, Whitestown, in the west Dublin suburb on October 29 last.
The accused is also facing a charge of producing a knife capable of inflicting serious injury contrary to section 11 of the Firearms and Offensive Weapons Act 1990 on the same date.
Detective Sgt William Kelly of Blanchardstown Garda Station gave evidence to Dublin District Court of arresting the accused yesterday morning at 11.05am.
He informed Dublin District Court that McGrath made no reply when charged with the two offences.
Dressed in a light brown shirt, jeans and runners, McGrath did not speak during the brief hearing which was attended by his mother and other family members.
Father of one, Tony McGrath, aged 23, was fatally injured as a result of an incident which took place at his home following a family christening in the early hours of October 29, 2006. He was rushed to nearby Connolly Hospital in Blanchardstown, but was pronounced dead a short time later.
A post mortem carried out by State Pathologist Dr Marie Cassidy found that Mr McGrath died from a single stab wound to the chest.
It is understood that the accused man was arrested at the time, but was subsequently released without charge as garda prepared a file for the Director of Public Prosecutions.
Judge Ann Ryan remanded the accused in custody to appear before Cloverhill District Court on August 8.
