Smith paternity battle to be settled this month

The photojournalist battling to prove he's the father of model/actress Anna Nicole Smith's baby daughter will find out if he is the daddy by the end of the month.

California judge Robert Schinder, who is presiding over the baby dispute, has ordered Smith to complete all paternity testing no later than January 23.

Smith's ex, Larry Birkhead, took his paternity case to court late last year after insisting he was the biological father of little Dannielynn.

Smith maintains her partner and attorney Howard K Stern is her daughter's father.

According to website TMZ.com, Smith and Birkhead can each choose the testing site of their choice, under the terms of the order.
