Saving Private Ryan actor Tom Sizemore has declined to give evidence in his domestic abuse trial in Los Angeles.

But he cried in court as he watched a video of his ex-girlfriend, former Hollywood madam Heidi Fleiss, declaring her love for him.

Both the defence and prosecution rested yesterday in the fifth day of the trial after Fleiss testified against him for a second time.

Sizemore, 41, who also appeared in Black Hawk Down, faces charges including threatening to inflict injury, vandalism and making about 100 harassing phone calls to Fleiss.

He faces up to 13 years in prison if convicted on all counts.

At one point Fleiss told the court Sizemore had destroyed her collection of figurines with a baseball bat.

She also said she became upset when she learned he was employing prostitutes during a movie shoot.

“I found it repulsive that he was trying to build a life with me at the same time,” she said.

Fleiss, 37, also reiterated a claim that Sizemore threatened the life of her younger brother.

“All the time we shared, all the experiences, it came down to ‘I’m going to kill your brother,”’ she said.

The defence case ended with a video shot by Fleiss in a hotel room she and Sizemore were occupying during a publicity tour for Black Hawk Down.

On it, she provided a singsong narration about their activities including an appearance on Howard Stern’s radio show and Sizemore’s appearance on Regis Philbin’s TV show.

“I can’t wait for Tom to get home to tell him how good he was, how handsome he is, how happy he makes me,” she said.

The defence suggests this contradicts her claim that on the same day Sizemore came to the hotel room and beat her so badly that both of them missed the premiere of the movie. Sizemore cried while the tape was playing.

Closing arguments were scheduled for later today.
