A US judge has temporarily prevented police from releasing a video shot during singer Diana Ross's arrest for drink-driving.

A US judge has temporarily prevented police from releasing a video shot during singer Diana Ross's arrest for drink-driving.

Ross's lawyer, Greg Davis, argues the video is not a public record because it was not made by the police officer who stopped the star.

He says the officer who shot the video did so only after learning that the driver was Ross.

Davis also says releasing the video would irreparably damage Ross's right to a fair trial.

Bev Ginn, representing the city of Tucson, Arizona told the judge the tapes were "made under the ordinary course of business".

Pima County Superior Court Judge John Kelly, who approved the temporary restraining order, set a date of January 14 to hear an application for a permanent injunction.

Several media outlets, including Inside Edition, the Arizona Daily Star and KOLD-TV, have requested copies of the video.

Ross, 58, was arrested on Monday for driving under the influence after police received a report of someone driving the wrong way down a Tucson street.

A breath test showed Ross had a blood-alcohol level of 0.20%, more than twice Arizona's legal limit of 0.08%, police say.
