Terms agreed for CPO assessment

The landowner or the local authority or NRA may seek independent assessment when agreement canot be reached on a settlement.

Assessment will be conducted by an independent person appointed from a panel established by the Chairperson of the Chartered Institute of Arbitrators Irish Branch.

Landowners will not lose their goodwill payment by opting for independent assessment, said IFA Infrastructure Services Manager, Thomas Ryan.

The independent assessment process requires a full exchange of reports and comments by each side.

Independent assessment costs will be borne by the local authority or NRA, where the amount determined is in excess of the amount offered by the local authority or NRA, or by the landowner where the amount determined is less than the amount offered by the local authority or NRA, said Mr Ryan.

The first independent assessment hearing will take place this month.

A presentation to all chairpersons of the IFA CPO Roads Groups, explaining independent assessment, will be given by the Chartered Institute of Arbitrators Irish Branch on June 8.
