A Los Angeles Superior Court judge ruled that Woods can proceed with the case as he sufficiently established that he could win. He initially believed that the case should be thrown out, but was later convinced by former USC linguistics professor Edward Finegan that the tweet appeared to be a factual statement.

The Twitter user is currently anonymous aside from their handle, @abelisted. Twitter has refused to provide their identity to date, but may have no choice if this case continues.

Abe List's lawyer has said that they will appeal the judge's ruling.
