The Law Society has defended the level of payouts for whiplash injuries.

Figures released yesterday by the Injuries Board show the average claim for a minor neck injury has reached almost €16,000.

They studied 51,000 claims over the past 10 years to create what is called the book of quantum; judges have to refer to the book when deciding damages for personal injuries cases. Payouts in 35 categories of injuries have fallen, while the same number have seen rises.

Whiplash accounts for between 70% and 80% of all claims. It is feared higher compensation will mean higher insurance premiums for drivers.

Senior Vice President of the Law Society of Ireland Stuart Gilhooley said they were happy with the rates, adding: "The only people that can make these decisions are the judges and as I understand it the judiciary is very happy with this.

"The book of quantum is based on current awards. The figure is (for all awards) up to €15,000. As I understand it, there have been no complaints about the levels (of compensation)."
