Three people have appeared before Clonakilty District Court charged in connection with an incident in which a stolen BMW was stopped near Ballinhassig, Co Cork, in the early hours of Tuesday.
Two 14-year-old boys, who cannot be named due to their ages, and 19-year-old Wayne Daly, of Farm Lawn, Manor Farm, Lehenaghmore, Co Cork, are charged with allowing themselves to be carried in a vehicle taken without the owner’s consent or lawful authority, contrary to the Road Traffic Act 1961. The juveniles cannot be identified because of their age.
Sgt Tom Mulcahy gave evidence of the arrest, charge, and caution of the two juveniles.
Judge Brendan O’Reilly told the parents present that, following the recent McCormack High Court decision, he was required to state that the boys aged under 18 were presumed innocent. As they were not legally represented in court, they were at a disadvantage, he said.
Both had previously consulted solicitors and applied for bail, to which gardaí did not object.
The court heard neither had previous convictions or been the subject of a bench warrant.
Bail was granted on their own €100 cash bonds, subject to conditions including that they live at their home addresses, attend school, sign on daily at a local Garda station, observe a 10pm to 6am curfew, remain contactable by phone, stay out of West Cork, and be of good behaviour.
They were remanded on bail to Bandon District Court on September 11 for directions from the Director of Public Prosecutions.
Detective Garda Neil Ryan gave evidence that Daly made no reply when charged.
Gardaí objected to bail, telling the court that Daly had 12 outstanding matters, including three alleged similar incidents.
Det Garda Ryan said Daly had been the subject of three bench warrants earlier this year, was already on bail, and was considered likely to commit further offences if released.
Daly told the court the warrants arose from mix-ups over court dates. He said he had recently begun a new job, had “got in with the wrong people”, and did not want to get into further trouble.
Sgt Mulcahy said Daly was already before the courts on a number of similar charges and was on bail at the time of the alleged offence.
Judge O’Reilly granted Daly bail on his own bond of €300 cash and an independent surety of €1,000, with €300 required in cash and a freezing order on the remaining €700.
He was also directed to live at his home address, sign on daily at Togher Garda Station, observe a 10pm to 6am curfew, remain contactable by phone, stay out of West Cork, and be of good behaviour.
Daly said he could not immediately raise the money and was remanded in custody, with consent to bail, to appear again at Clonakilty District Court on August 27 for directions from the DPP.
