Man charged with sexually assaulting his daughter in Cork and Wexford served with book of evidence

The two counts of sexual assault are said to have happened on dates between January 2019 and May 2021

A 43-year-old man was served with a book of evidence on Tuesday on two counts of sexually assaulting his own daughter on dates between January 2019 and May 2021.

Detective Garda Mary-Jane Somers served the book of evidence on the defendant on the two charges of sexually assaulting his daughter at an address in County Wexford in 2019 and at a house in Cork between May 2020 and May 2021.

Sergeant Gearóid Davis confirmed at Cork District Court that the book of evidence had been served.

Defence solicitor Diane Hallahan asked for free legal aid to be extended to include a barrister for the matter being dealt with at the circuit court.

Judge David Waters gave the accused the standard warning that he would have to notify the prosecution if he intended to rely on an alibi defence. The case was then sent forward to the next sessions of Cork Circuit Criminal Court commencing on October 27.

Detective Garda Somers said earlier this month when the matter first came before the court that there was no objection to bail on conditions that require him to have no contact with the complainant, directly or indirectly, to sign once a week at his local garda station and to provide gardaí with a mobile phone number on which he would be contactable at all times.

Because of the nature of the case there is a prohibition on identification of the parties.
