Court action brought by senior garda challenging his suspension is resolved
High Court heard the matter had been 'amicably resolved' following out-of-court discussions.
A High Court action brought by a senior garda challenging his suspension from his job has been resolved.
The action had been brought by Garda Chief Superintendent Patrick Diskin against the Garda Commissioner, the Minister for Justice Ireland and the Attorney General.
Represented by Ercus Stewart SC, Mr Diskin had sought orders in his proceedings, including an injunction lifting his suspension.
The application for an injunction, the High Court heard, was brought as a matter of urgency because the plaintiff is due to retire from An Garda SĂochána in the coming days.
The plaintiff wanted his suspension lifted before his scheduled departure from the organisation.
He had been suspended from his role some time ago, on foot of allegations he had engaged in inappropriate behaviour and language at the workplace on dates between 2015 and 2018.
Chief Superintendent Diskin had strongly denied any wrongdoing.
On Wednesday, when the injunction application was due to be heard by the court, Mr Stewart, appearing with John Curran Bl, told Mr Justice Mark Sanfey the matter had been "amicably resolved" following out-of-court discussions.
Counsel said both the injunction application, and his client's entire proceedings, could be struck out.
No details of the settlement, which is confidential, were revealed in open court.
Counsel for the defendants, Conor Power SC, said his side was consenting to the settlement, and added his clients wanted to "wish Chief Superintendent Diskin well" on his impending retirement.
Mr Justice Sanfey welcomed the settlement and praised both sides' legal representatives for bringing about a resolution of the dispute.
