Minister wins appeal over ruling on bid by partner of EU citizen to stay here
The Minister for Justice has won his Supreme Court appeal over a ruling in favour of a man's bid to stay here on foot of his relationship with an EU citizen.
The five-judge court stressed its judgment rested on legal findings, not on any factual finding by it that the man, a third country national, is not in a “durable” relationship with a Spanish citizen who lives and works here.
