O’Donnells previously agreed to vacate Gorse Hill, court told

The Court of Appeal has heard that Brian O’Donnell and his wife had previously agreed to hand over possession of the Gorse Hill mansion in South Dublin.

Mr O’Donnell is appealing against the trespass order granted by the High Court.

Senior Counsel for Bank of Ireland Cian Ferriter told the court that receivers have had a legal right to possession of the Killiney property since June of 2012.

He has argued that damages would not be enough of a remedy if the High Court trespass order is overturned - and that the Bank would lose €12,000 a month in potential rent while the O’Donnells remain there.

He said that a number of legal documents and court rulings have upheld the status quo - that the Mr and Mrs O’Donnell had previously agreed vacate the Killiney property.

Mr Ferriter told the court that the four adult O’Donnell children had made an undertaking to the High Court that if they lost an action trying to prevent repossession, that they would vacate the house.

Ms Justice Mary Finlay Geoghegan yesterday told the court that the matter must be finished today.
