An IT worker who claims he got stuck in the mud and broke his ankle while watching Kings of Leon at Oxegen is suing the festival promoters.

Mark Ponisi of Roselawn, Tipper Road in Naas, Co Kildare has brought a High Court action for damages against MCD, who deny negligence.

Mr Ponisi claims he was thrown violently to the ground while watching Kings of Leon at the Oxegen festival in July 2007.

He alleges his feet got stuck in mud and that he was unable to move during a crowd surge.

He is suing festival promoters MCD claiming the ground surface was unsafe.

They deny negligence and say they exercised all reasonable care.

Ms Justice Mary Irvine will deliver judgement next Thursday.
