The High Court has today ruled to strike out part of a legal action by an elderly couple who are suing IBRC following their eviction from their south Co Dublin home.

The High Court has today ruled to strike out part of a legal action by an elderly couple who are suing IBRC following their eviction from their south Co Dublin home.

Brendan and Asta Kelly's story came to prominence when they lost their five-bedroom Killiney house last April over a €2m mortgage debt to the former Anglo Irish Bank.

Last week IBRC raised objections to part of the couple's claim which led to them registering a notice that there was a legal action pending over the property.

The court has agreed with the bank that this part of the action was introduced by the Kellys in the hope of frustrating a sale and would constitute an abuse of process if it was allowed to proceed.
