The High Court has cleared the way for a legal challenge to An Bord Pleanala's decision to approve planning permission for a largescale retail development in Ballincollig,Co Cork.

Leefield Ltd, trading as Supervalu, opposes plans for the 70,000 square foot development at the former military barracks where Tesco is likely to be the anchor tenant.

A review of An Bord Pleanala's decision last July will centre on its alleged failure to explain why it deviated from recommendations it received in an inspector's report.

Leefield's lawyers told the court there are concerns the proposed development would be a one stop shop for consumers that will sterilise business in the rest of the town.
