Alleged attack teen walks as complainant gets 'cold feet'
A Dublin teenager, who denied attacking and injuring man during a fight in which he allegedly used a bottle as a weapon, has escaped trial because the complainant had “cold feet” and would not come to court.
The 16-year-old boy, who is taking part in a training course, had been charged at the Children's Court with assault causing harm to a man, in Crumlin, in Dublin, on September 12 last.
The teen had pleaded not guilty to the charge and was back in court today for a hearing of the case.
However, Judge John O'Neill struck it out after hearing that the alleged victim gpt “cold feet” and would not come to court to give evidence against the boy, who was accompanied to the hearing by his mother.
In an outline of the evidence, Garda Dave Finnerty had told the court earlier that that the defendant and his brother were involved in an argument with the alleged victim.
It was alleged that the teen “struck the injured party with a bottle to his head.” The complainant was taken to hospital where he received treatment to an open head wound.
Garda Finnerty had also said the alleged victim had been left with slight scarring to his head.
