Prosecution case concludes in murder trial

The prosecution case against four men accused of the murder of a Limerick bouncer has concluded at the Central Criminal Court today.

Gary Campion (aged 24) of Pineview Gardens, Moyross, Limerick, John (aged 27) and Desmond (aged 23) Dundon, both from Ballinacurra Weston, Co Limerick, and Clare businessman Kelly (aged 50) with an address at Killrush all plead not guilty to murdering Mr Fitzgerald, at around 3.50am on November 29, 2002 at Brookhaven Walk, Mill Road, Corbally, Limerick.

During more than 12 days of evidence, the jury of 12 men have heard the state's case, mainly through the evidence of James Martin Cahill, who is serving a life sentence for shooting Mr Fitzgerald.

The State alleges that Gary Campion drove the motorbike used in the murder, while Anthony Kelly provided the gun used and John and Desmond Dundon identified the victim.

Desmond Dundon is also accused of calling Cahill to tell him the victim was on his way.

Today, the jury heard evidence from taxi driver Mr Noel Irwin. He told gardaí that he picked up two young men from Desmond Dundon's address at around 4am on November 29, 2002 and took them to Burger King in Limerick.

Detective Sergeant Patrick O'Callaghan confirmed to Mr Roger Sweetman SC, defending Mr Dundon, that Desmond Dundon told gardaí when he was interviewed after the shooting that he took a taxi to Burger King with his cousin at around 4am that morning.

The trial continues in legal argument before Mr Justice Peter Charleton and will continue tomorrow before the jury at the Central Criminal Court sitting at Cloverhill.
