The European Court of Justice is to rule on the legality of the €20 fee charged to people who want to make submissions on planning applications in Ireland.

The European Commission has referred to the matter to the Court of Justice to see if it breaches the EU's environmental impact assessment directive.

Friends of the Irish Environment made the original complaint to the commission after the legislation introducing the fee was published in 1999.
