Government claims that it is not in breach of constitution
The counsel for the State says that the prisoner who is trying to stop the referendum on the Nice Treaty has failed to show how the Government is in breach of the constitution.
The 42-year-old inmate, Patrick O’Doherty, is serving two years for tax offences and he claims that the Government is going against his constitutional rights by not allowing him to vote in the referendum.
The Government argues that its hands are tied in the matter because they cannot allow voting to take place inside the prison nor can they release Mr O’Doherty.
