The Garda Commissioner has refused to tell the Abbeylara inquiry why a third shot was fired at John Carthy when he appeared to be falling.

Pat Byrne said he would leave the answer to that question to the Assistant Commissioner, Tony Hickey.

Commissioner Byrne told the inquiry that Mr Carthy would not engage with negotiators.

Asked why the gardai had not purchased cigarettes for him, the Commissioner said the request had come at around 3am, when no shops were open.

An attempt by legal counsel for some members of the Garda ERU, John Rodgers SC, to change the procedures of the inquiry was rejected.
