Powerscourt claim fails

A woman who brought her 83-year old mother on a day out to Powerscourt Gardens, Co Wicklow, but sued after she fell and fractured her wrist when her mother’s wheelchair went out of control on a steep slope has lost her High Court action.

Mr Justice Anthony Barr said he was satisfied clear instructions had been given by a Powerscourt receptionist to Jean Chambers and where she had been supplied with a clear map of the gardens, Powerscourt Estate had not failed in the common duty of care it owed her.

Jean Chambers, aged 48, of Cedarwood Road, Glasnevin had sued Powerscourt Estates Ltd as a result of the fallon September 13, 2014.
