A wrongful death lawsuit has been filed against Aisling Brady McCarthy by the parents of Rehma Sabir, the one-year-old girl the Irish nanny was accused of killing.

Sameer Sabir and Nada Siddiqui claim in the lawsuit filed in Middlesex Superior Court in Massachusetts the baby died due to Brady McCarthy’s “negligent, malicious, willful, wonton, reckless and/or grossly negligent acts.” The first degree murder case against Brady McCarthy collapsed last August after the prosecutors admitted the evidence against her, particularly relating to medical examinations, was flawed. She spent more than two years in jail following the January 2013 death of Rehma.

The Cavan woman, who was in the US illegally, immediately returned home. In an interview last month, she raised the possibility of suing prosecutors and the doctor who claimed Rehma died from blunt force head trauma after being violently shaken.
