A dispute over the ESB’s decision on the award of contracts worth €150m for the maintenance of overhead power lines has been admitted to the Commercial Court list.

The action has been brought by Powerteam Electrical Services Ltd which seeks a review of the ESB’s decision last December that Powerteam’s tender for admission to the multi-operator framework agreement for overhead lines works was unsuccessful.

Powerteam, which provides services in relation to overhead power lines, also wants the ESB’s determination admitting six other parties to the agreement to be reviewed.

The value of the agreement, which is for building and upgrading works and maintenance of power lines within the State over three years, is approximately €150m.

The work includes the repair of power lines damaged in storms.

Mr Justice Brian McGovern on the consent of both parties admitted the case to the fast-track Commercial Court list.

The judge also fixed for Friday of this week the hearing of an application by the ESB to lift the automatic suspension of the framework agreement from being implemented brought about by Powerteam’s action.
