€120k for boy injured by basketball unit fall
Dawid Galek, the High Court heard, lost some of the top of his ring finger and little finger in the accident.
Dawid Galek, of Waterside Walk, Malahide, had, through his father Krzysztof Galek, sued Kids Inc Ltd, which runs a creche at Seatown Rd, Swords.
It was claimed that in September 2012, while under the care, management, and supervision and control of Kids Inc, part of a basketball unit fell on the boy’s left hand, injuring him.
He further claimed there was an alleged failure to have any regard for his safety.
Mr Justice Kevin Cross was told the matter, which was before the court for assessment of damages only, had been settled for €120,000.
Barrister Vincent Foley said the boy suffered the injuries to his left hand and had used that hand to write, but now had an excellent grip with the right hand.
Dawid, he said, was a lovely boy who was doing very well in school. Mr Justice Kevin Cross said he had no hesitation in approving the settlement.
The court heard the young boy had to have plastic surgery to his fingers and has been left with a shortened ring and little finger after the accident.
