A man in a chip shop punched another man to the floor and went away to get a stick to attack him again because he took exception to the injured party calling him by his nickname — Boo.

David Butt, of 16 Thomas Davis St, Cobh, pleaded guilty to charges of engaging in threatening behaviour and producing a stick in the course of a dispute to intimidate or injure.

Inspector Mary King outlined the details of an assault captured on CCTV but said the injured party did not want to proceed with a complaint against Butt.

After 12am on February 14, the injured party went to Donatello’s takeaway in Blackpool, Cork.

“The injured party referred to him by his nickname, Boo,” said Insp King.

“Mr Butt took offence and punched the injured party and kicked him on the ground. The injured party defended himself by punching Butt. Mr Butt left but returned a short time later and struck the injured party with a stick-type object.”

Butt, who is serving a sentence, has 47 previous convictions.

Judge Con O’Leary put the matter back a week for defence solicitor Eddie Burke to get the views of the defendant on referring the matter to the system for Restorative Justice.
