Warrant over fear caused in yard
Judge Con O’Leary convicted Christy Casey Sr of trespassing on John Cashman’s property at Gornalahee, Carrignavar, Co Cork, in a manner likely to cause fear on Aug 12, 2012.
The judge convicted Casey, aged 54, of Ryefield, Whitechurch, Co Cork, a fortnight ago and issued a warrant for his arrest so he could be in court yesterday for sentencing.
Insp Mary King said the warrant for Casey’s arrest had not been executed.
Judge O’Leary said: “I would be anxious that the warrant would be executed early having regard to his indifference to proceedings.”
The inspector said the matter would be given.
The judge did not issue warrants for two co-accused, two of Casey’s sons, Christy Casey Jr, aged 23, and Tony Casey, aged 22. They were also convicted last month on trespassing in a manner that caused fear.
The judge said gardaí could notify the sons to attend in a fortnight for sentencing. “The only warrant will be a committal warrant if I decide to imprison them,” the judge said.
Mr Cashman previously gave evidence during a trial of the three Caseys, none of whom attended. He said: “I was afraid of my life of them. I got my shotgun. Five minutes later we heard the Caseys coming in the drive. I fired one shot in the air. The car reversed. I fired a second shot in the air.”
The background to the case was that Mr Cashman said he was owed €8,500 for work he did for the Caseys and there had been civil court proceedings.
