The Labour Court has found in favour of a clinical nurse manager who moved from her job at Tullamore Hospital after her line manager accused her of being “emotional and hormonal” due to her pregnancy.

When two HSE investigations into the alleged bullying and harassment by a colleague stalled, the claimant moved to a role as a community health nurse in Portlaoise.

The Labour Court now recommends that she be restored to the clinical nurse manager position she held in Tullamore as soon as possible, and that, in lieu of the additional mileage and time involved in her commute to Portlaoise, she should be given two extra weeks of additional annual leave phased over two annual leave years.
