Retrial for man sentenced to life

THE Court of Criminal Appeal has quashed the conviction and ordered a retrial of a Dublin man accused of murdering one of his friends and stabbing another in the heart.

Martin Toland, aged 35, was jailed for life by Mr Justice Patrick McCarthy in January last year after a Central Criminal Court jury found him guilty of murdering Alan Nolan, aged 28, at his apartment at Cedar Brook way, Ballyfermot, in the early hours of September 8, 2007.

Toland, of Walkinstown Park, also received a concurrent seven-year sentence on a second count of recklessly or intentionally causing serious harm to James Carroll, aged 31, on the same date. He had pleaded not guilty to both charges.
