A CORK woman has consented to judgment for some €2.6 million against her arising from loans advanced by ACC Bank to her and others.

Eileen Daly, Kinvara, Woodleigh Park, Model Farm Road, Cork, consented to the judgment arising from two separate loans advanced in 2005 to her and Gary Hyde, Bramley Hill, Rathcooney, Co Cork; and also from a third loan advanced to her and her husband, Seamus (Shay) Daly.

The monies advanced to Ms Daly were for the purchase of The Castle Tavern, Glanmire, Co Cork, ACC said. The bank had appointed a receiver over that premises in May 2009 and Ms Daly later consented to an order for possession made in favour of the bank.

At the Commercial Court yesterday, Mr Justice Peter Kelly refused to transfer to the Commercial Court ACC’s separate proceedings against Mr Hyde because of problems with legal documents presented in connection with that application to transfer.

In those proceedings, ACC sought summary judgment of just over €1 million against Mr Hyde. There was an issue about the authenticity of Mr Hyde’s signature on certain of the loan documents, the judge was told.
