A CASE against a garda accused of having a bald tyre on a car after an incident in which a man died can proceed, a judge ruled yesterday.

Garda Damien Carey, aged 27, from Lucan in Dublin, was facing a charge of having an “excessively worn” tyre on his privately owned car, while off-duty, at Main Street Lucan on March 4 last.

Derek O’Toole, aged 24, from Clondalkin in Dublin, died of crush injuries consistent with the wheels of a vehicle going across his body. The inquest into his death last October heard he had been lying on the road at the time.
