Gardaí seek to stop second inquiry
Gardaí Rudy Kelly and Gary Lee, of Balieborough Garda Station, Co Cavan, were involved in the incident in which Garda Kelly was filmed talking to a member of the public who had phoned the station to complain about boy racers near his home.
The High Court heard yesterday the two gardaí were told the penalty they faced would be relatively minor. They pleaded guilty at the disciplinary proceedings on this basis.
However, the Garda Ombudsman Commission subsequently became involved and appeared to have directed there would be a new investigation.
Mr Justice Peart granted an order prohibiting a further investigation pending a full hearing and ordered that notice be served on the Chief State Solicitor.
