Deasy may be first to get €3,000 smoking fine
The South Western Area Health Board in Dublin yesterday confirmed it will inquire into the circumstances surrounding Mr Deasy's smoking incident in the Dáil bar on Tuesday.
Under the new legislation, fines of up to €3,000 can be imposed on those who breach the ban.
Last night, Mr Deasy said he would not comment at this stage on the possible investigation but reiterated strongly he had no regrets about smoking in the Dáil bar on Tuesday night.
As Dáil colleagues in Fine Gael and other parties described his actions as foolish and irresponsible, the Waterford TD said everyone was entitled to their opinions but he trenchantly disagreed with them. "A lot of people are being unnecessarily ostracised because of the smoking ban. There is a puritanical and dictatorial attitude to a certain extent," he argued.
Mr Deasy said when party leader Enda Kenny told him he was being sacked from the justice portfolio late on Wednesday night, the conversation was cordial.
"He had a decision to make. I wished him well," he said. Since being elected to the Dáil two years ago, Mr Deasy, 36, has gained a reputation as a maverick.
Last night he said he was sure some FG colleagues were not sad to see him go, while others were sorry.
"People accept things too readily from the Government. In relation to the smoking ban, I was looking for some accommodation. I can't argue with the health aspects but I believe personal freedom is being ignored," he said.
Yesterday, Mr Kenny said he had sacked Mr Deasy as his position as Fine Gael justice spokesman was untenable. "Politicians must lead by example. They must take responsibility for their actions," he said.
Mr Deasy smoked in the bar 'in frustration' when unable to access a courtyard. He was told by bar staff and fellow TDs to put out the cigarette but continued smoking. The courtyard was designated a smoking area 24 hours later.
