EIGHT years after Frank McBrearty Jnr first claimed he was wrongfully arrested for a murder that never happened, the State stands accused of attempting to further delay a High Court hearing by the Donegal man.

McBrearty eight years on: State ‘delaying his case’

As Mr McBrearty Jnr’s legal team, worried over his health, attempt to get an early hearing, the State Solicitor’s office has asked the High Court to delay it until after Mr Justice Frederick Morris’s next interim report. The State claims this will happen during the next term.

Mr McBrearty’s lawyers claim that testimony on the wrongful arrest will not even be heard before the second report is published, and will argue in court next week it’s just another in a long list of delaying tactics.
