Derogation or court choice

UNLESS farmers intend to take on the European Court of Justice, they must now concentrate on Ireland’s bid to get a derogation from the Nitrates Directive farming limit of 170 kg of organic nitrogen per hectare.

The limit is here to stay.

European Court judgements against the Netherlands in particular, and more recently against Ireland, found that compliance with the letter of the Directive is an absolute requirement.
