A judge threw out a case about Polo mints today, saying it was an appeal “with a hole in the middle”.

Nestle had challenged a High Court ruling rejecting its application to register a trademark showing the familiar shape of the mint but without the word “Polo” embossed on it and no specification of size or colour.
