An Austrian waitress is to go on on trial accused of negligence for allowing a drunken customer take part in a game that killed him.

An Austrian waitress is to go on on trial accused of negligence for allowing a drunken customer take part in a game that killed him.

The 30-year-old broke his neck and died in hospital three weeks later after hitting a wall with his head as part of a game inspired by the popular MTV show Jackass.

The show features people doing dangerous stunts and has been blamed for numerous injuries to people – mostly teenagers – trying to imitate the stunts.

The 29-year-old waitress, which court officials in the Tyrol identified only as Ceca B, is accused of urging the man to join the game even though he was drunk.

“She must had known that he was under strong influence of alcohol,” said prosecutor Herta Krainer.
