Kieren Fallon can ride Recital in the Investec Derby at Epsom on Saturday after the High Court refused to grant an injunction preventing him taking part.

The question of whether Fallon will be able to ride Recital therefore remains up in the air.

Mr Justice MacDuff said he was not prepared to grant the injunction sought - but gave the owners permission to appeal against his decision.

It is thought that their challenge could go to the Court of Appeal this afternoon.

Fallon has won the Epsom Classic on three previous occasions, North Light (2004), Kris Kin (2003) and Oath (1999).
