THE decision by the High Court in relation to risk equalisation in the area of private health insurance will have serious, but not immediate, implications on a number of fronts.

Ms Justice Mary Finlay Geoghegan decided that the Government plan could go ahead on January 1, thus refusing the application by BUPA to have the scheme deferred pending the result of its High Court challenge to the legislation.

The substantive issue of whether risk equalisation is legal will not be tested until Bupa’s challenge commences.
